Personally, I can't believe she hasn't done it already. I guess that speaks volumes about her grossly incompetent public service and private legal teams. This is, after all, Constitutional Law 101. Also means she ain't too swift either. But that comes as no surprise. At least TheUndertakerTM has a brain in his head.

What Smith will do is consult with First Nations as soon as the decision is on appeal. And what will the appeal court do if she fulfills the consitutitional requirement between now and when the appeal judgement finally comes out?

Nope. Think about it as a native Albertan. Every time a court interferes with the referendum process what is the inevitable political result? Each judgment from a federal court is an automatic tick up in support for the separatists. Quebec separation will not be dictated by courts and neither will the effort in Alberta. We need to beat them fair and square (50% + 1) without court interference. Quebec will never tolerate the Clarity Act and neither will Alberta. Any fool who invokes it will be responsible for the civil war that erupts in that province as a result of federal interference. In short, fuck the Clarity Act! But...God bless Chrétien. He thought he was doing the right thing…
